You just watched "Bridal to Homicidal" on E! Network.  You heard Marjorie Orbin's voice.

She was talking to me when that tape was recorded.

Listening to those jail tapes as I prepared for the E! show, I remembered there was a lot more this remarkable woman had said to me that had never seen the light of day. I suddenly realized there was now a way I could let you in on that....and at the same time explain why E! needed my tapes.





You saw me, in the white suit, talking to the camera on "Bridal to Homicidal." You also see me here standing next to Marjorie. Why do I look so different in the two images?  I realized I had a chance to explain that, too.  (Hint: it has nothing to do with makeup or lighting)

So what I've done is prepare a special edition True Crime Short specifically to be a companion to the TV shows you see on Marjorie Orbin, especially "Bridal to Homicidal."

This True Crime Short is not a re-hash of what you've already seen on TV or read in my book, WHAT SHE ALWAYS WANTED.

Marjorie Orbin -- Where is She Now?

Marjorie Orbin's full story plays out in my book published by Penguin (Berkley), WHAT SHE ALWAYS WANTED.  There you can find the details of her marriages, love affairs, and the awful crime at the center of her story.   But after you read the last page, you'll be curious about Marjorie now.

She continues to live her life...behind bars. She's been out of the county jail for about 2 years now and in the state system. The last time I talked to her in person she was looking forward to the transfer for a variety of reasons, one of them being inmates are fed three times a day in the state prison rather than early morning and mid-evening (no lunch) at the jail.  After settling into state prison, she wrote me that she was "happy" there.

According to prison records, she has recently had a minor disciplinary infraction. In February (2012), prison administrators report they found her guilty of illicit "barter/trade/sell."  This is a Class C infraction which can be settled with relatively minor disciplinary action including confiscation, loss of privileges, or extra duty. It can even be "settled informally."

Even with the violation, Marjorie has also recently earned a reduction in her "Risk to the Public" score. She came into the system as a maximum level 5. This is based mostly on the crime itself and other similar immutable factors.  A few days after being found guilty of the "barter/trade/sell" infraction, she was downgraded to a level 4 in her "Risk to the Public" score.

Marjorie is currently doing a work assignment, according to prison records, as a "kitchen helper."

Marjorie Orbin Juror Speaks Out

With the airing of shows like 48 Hours: Mystery (Diary of a Showgirl), Scorned (The Showgirl and the Salesman), and others, thousands of new people are arriving at this blog every day. They are sharing their opinions in the comments sections and asking the questions inspired by the shows. I'm answering some questions, but couldn't have been more delighted to discover commenting here a source a level higher than mine in the heirarchy of the case. I attended the trial, but this commenter was part of the trial. 

We have a member of the jury speaking out in this post.

Although this juror did not identify by name, I recognize certain "insider" details in this posted comment that are consistent with the actual jury.  All the thoughts shared here are consistent with what several jurors did share with me face to face.  Juries frequently want to keep their privacy, particularly in a murder case. There are many reasons for that, safety being a prominent one. Serving on a jury in a case like this is a very rattling experience and I will absolutely respect this juror's privacy and anonymity on the web.


But if you have just watched one of these shows, you might very well want to take a look at what this juror has to say.  The juror addresses why Marjorie Orbin received the sentence she did and the fairness of the trial, among other things:

Hello from juror # - oops, I seem to have forgotten my juror number. One of my fellow jurors just sent out an email wondering how Marjorie's appeal turned out and I sent them all back a link to your blog.

We all agreed that the evidence of premeditation was overwhelming.

[a commenter earlier in this thread--ck] - had you been in the court for the trial and listened in on our deliberations you would be in little doubt that she did receive a fair trial and a just verdict. Our concerns during the sentencing phase of the trial were, in part, the welfare of Noah and the possibility that he might at some point in his future life wish to see his mother.

[see clickable link above for thread--ck] who wondered how she could have moved Jay Orbins body to the desert - don't forget that she moved him in parts and that she had a ramp she could use to move the body up into her vehicle. Also, she was a physical fitness fanatic and was much stronger than you imagine.

One final thought that came to me as I was reading over the comments above - we did discuss the theory presented by the defense that pointed to Larry as the guilty party. The problem with that theory is that there was no evidence presented that would support the theory and it seemed to us to be little more than a distraction provided by a defense that had no real exonerating evidence to present.

Thank you, Juror #Oops!  I am happy to bring your insights to a larger audience. This case has received so much attention, that people around the country are second-guessing this jury's decision without enough information to go on.

"Didn't she have something to say about her boyfriend? Exactly how long had she known this guy Larry Weisberg?
      'Three or four months,' Marjorie said. 
                 'He's using you,' said Lane. 
               
                 'Using me for what?' she asked.
Lane said Weisberg was a big guy, a tough guy, he must be jealous of Jay. Marjorie said there wasn't really anything for him to be jealous of...."

Marjorie Orbin's Appeal

Marjorie Orbin, the subject of my book, WHAT SHE ALWAYS WANTED, is a very confident woman. From the Maricopa County Jail, and later from an Arizona state prison, she would write to me that she “knew” she would prevail upon appeal. In fact, shortly after her sentencing, she wrote me that she expected to be out of prison in “a year and a half.”

Well, she has just had the second anniversary of that sentencing, but she’s still behind bars. Because the Arizona Court of Appeals has denied her wish for a new trial.

If you have read WHAT SHE ALWAYS WANTED, you know that there were numerous problems with Marjorie’s trial. Bizarre, unforeseen twists and turns in that proceeding gave Marjorie and her supporters room to hope that the whole shebang would be tossed on the slag heap and she could try all over again with a shiny new jury who had never heard of her. 

But Marjorie may have failed to consider the intricate subtleties of law. In a unanimous three judge decision, all the troubles that plagued Marjorie’s trial have been deemed, in one way or another, irrelevant to the outcome.

Perhaps the most publicity-oriented complaint Marjorie and her attorneys had about her trial centered on video tapes that were used by the TV show 48 Hours. In an episode they named “Diary of a Showgirl,” the case of Marjorie Orbin played out frame by frame. As described in WHAT SHE ALWAYS WANTED, an angry hearing took place after the show in which Marjorie’s lawyers unsuccessfully argued some home videos in Diary of a Showgirl should have been given to them to use in the trial, not to a TV crew to use on the air.

The Court of Appeals has ruled that, first, the tapes were never in the possession of the prosecution but only in that of Jake Orbin, Jay’s brother. Jake qualified as Jay’s heir and executor and, under the law, a victim of the crime. He had no obligation to turn the tapes over. Moreover, “the court found Defendant had personal knowledge of the existence of the tapes yet never requested them until after the verdicts.”     This very point was made, in my presence, by Judge Anderson himself at the original hearing. How could the tapes have been “undisclosed” when Marjorie herself knew about them all along?  After all, she appears in them! The Court of Appeals, as did Judge Anderson, seemed to consider it some kind of mendacious gamesmanship that the defense would ignore the tapes until the trial was over, the verdict was in, and some strangers happened to put them on TV.

The other big ticket item was the investigation of then Homicide Detective Dave Barnes. The court ruled that this spectacle, as eyebrow-raising and unusual as it was, did not “go the foundation of [Marjorie’s] case.”  They also said Judge Anderson’s handling of the calamity did not impair any of her rights.

​Okay, so there was another big ticket item: Prosecutorial Misconduct. This was a complicated affair that you’ll have to read the book to unravel, I don’t have enough space here. But the three appellate judges studied it and concluded, “We find no abuse of discretion.”

On another issue, one in which Marjorie’s defense was trying to blame Marjorie’s former lover for the murder--a defense known as “3rd party culpability”--the court ruled the defense’s position was “an incorrect statement of the law and would have misled the  jury.”

And finally, Marjorie’s lawyers had argued about expert testimony that they had wanted disclosed much earlier. Of note to those also following the sweat lodge trial, the trial court basically ruled that the prosecutor botching a timely disclosure does not magically create reversible error. In several pages of legalese, the Court of Appeals spelled out that while the prosecution had, indeed, botched it, the trial court made sure the defense ultimately had ample time to review and present the material. No harm, no foul.

Marjorie has other appeal options open to her. The process will continue. But she has missed her goal of being out “in a year and a half.”  And the Orbin family is spared the ordeal of going through a whole new trial.
